In a2016 federal filing, SolarCity wrote, "If the Internal RevenueService or the U.S. Treasury Department were to object to amountswe have claimed as too high of a fair market value on such systems,it could have a material adverse effect on our business, financialcondition and prospects." The firm stated, however, that its valueswere correct and complied with the Treasury Department guidelines.If the Treasury Department or IRS disagrees, SolarCity and otherfirms could be forced to reimburse institutions that purchase theirtax credits as investments.

The "Solar by Degree" project received thetax credits, but it was later shown that the company named on theinvoice, Solar Foundations, does not exist. In addition, Daviesclaims he did not write nor has ever seen the RedCo letter inquestion and that his name was forged. Relying on this evidence,the state claims Shain forged both documents. Shain denies forgingthe invoice and claims it was given to him by someone else involvedin the project. The tax credits involved were given to SolarCity,the third developer in the project, along with its financialbackers. According to The Oregonian, "Those backers provide upfrontfinancing for the projects in exchange for a share of the projectrevenues and the federal and state tax credits, which they can useto offset their own taxes." SolarCity stated, "We financed andconstructed the projects in accord with the requirements of theOregon Department of Energy." The company argues that the statehired Shain, and it had no knowledge of the phony documents inquestion, otherwise it would have not pursued theendeavor.

The company is involved in a case concerning Martin Shain,the lead energy consultant in a solar power project at two Oregonuniversities. Shain was indicted for forgery in Marion County inAugust 2016. He is a consultant for BacGen Technologies in Seattle,a key player in the controversial $24 million "Solar by Degree"project and is accused of "creating a phony invoice from afictional subcontractor that was pivotal in getting nearly $12million in tax credits from the Oregon Department of Energy". Theproject began in 2013 and was sponsored by the Oregon UniversitySystem; thousands of solar panels, generating millions of kilowattsof power per year, were constructed on 21 acres on the campuses ofOregon State University and the Oregon Institute of Technology inKlamath Falls.

According to The Oregonian,the request to Rosenblum "singled out one company: California-basedSolarCity. It outlined several complaints filed against the solargiant by Oregonians who claimed they'd been misled about costs, taxcredits and energy savings by the company."

As late as May 2016 SolarCity said that itwas cooperating with federal agents who had been in contact withthe company.

In February, three executives who worked for LPCiminelliDevelopment who were arrested in 2016 in a federal bid-rigginginvestigation motioned to have the case against them eitherdismissed or moved from Manhattan to Buffalo. The three men face a14-count indictment for wire fraud and bribery and alleged bidrigging of the SolarCity RiverBend construction contract.Additionally, five other people have been charged with relatedcrimes. The trials will begin in late spring of 2017.

The United States attorney's office for the SouthernDistrict of New York is leading a federal inquiry into BuffaloBillion. Prosecutors subpoenaed several state institutions who wereresponsible for SolarCity and other components of the BuffaloBillion project. The subpoenas sought information about howgovernment-funded programs were awarded and what the role was ofstate officials who selected the winners. Cuomo has stronglydefended the project noting that there has been a decrease inunemployment and an increase in spending around the Buffaloarea.

On April 29, 2016, then-U.S. Attorney Preet Bharara (ofthe Southern District of New York) began an investigation intostate construction projects and contracts. Buffalo Billion was apart of that investigation. Many companies have been subpoenaed,and have provided information, including SolarCity and the officeof New York Governor Andrew Cuomo. SolarCity is not the subject orfocus of the investigation, and not involved in the vendorselection or contracting.

As of May 2016, federal investigators were investigatinghow money and contracts within the Buffalo Billion program weredistributed. SolarCity was a partner in the program. The companyintended to open a large solar panel factory on the Buffalo River.In May 2016, New York State officials postponed the approval ofalmost $500 million for the SolarCity project. According to The NewYork Times, Buffalo Billion will benefit "a tangle ofwell-connected players – including developers and frequent donorsto the governor – who have feasted on Buffalo Billionmoney".

The factory will be located in an "innovation hub" calledthe High-Tech Manufacturing Innovation Hub at RiverBend. The stateappropriated $750 million in funding for the hub. According toDaily Energy Insider, "The facility will have one gigawatt ofannual solar capacity when it reaches full production and i***pected to produce about 10,000 solar panels per day." SolarCityis required to spend $5 billion over the next decade on thefacility and create more than 1,460 direct manufacturingjobs.

Buffalo Billion is a billion-dollar program from theadministration of New York Gov. Andrew Cuomo. The program'sintention is to revitalize Buffalo New York in areas across WesternNew York. One of the main features of the program is a 1.2 millionsquare foot solar panel factory called SolarCity RiverBend. It willbe owned by SolarCity. The factory "is expected to become thelargest manufacturing facility in the Western Hemisphere when itopens". Hiring for the factory is expected in spring of 2017 andthe factory is expected to begin producing solar cells by thesummer of 2017.
